Terms and Conditions/Short Term Accomodation Licence Agreement
- Payment of the Licence Fee / Accommodation fee constitutes the client’s acceptance of the terms of this agreement.
- Nature of Agreement
2.1 This Agreement is a licence to occupy the Premises on the terms set out below
2.2 This Agreement does not create a lease, tenancy, sublease or any estate or interest in land
2.3 The parties acknowledge and agree that the Residential Tenancies Act 1997 (Vic) does not apply, as the Premises are ordinarily used for holiday purposes (s 10). - Premises and Term
3.1 The Licensor (Bungunyah Apartments) grants the Licensee / Guest permission to occupy the Premises.
3.2 Occupation is strictly limited to the period commencing from the check-in date and ending on the check-out date (“the Term”).
3.3 The Licensee / Guest has no right to remain in occupation after the Term and must vacate promptly at the end of the Term. Failure to vacate the Premises at the end of the Term will constitute a trespass pursuant to s 9 of the Summary Offences Act 1966 (Vic). - Licence Fee
4.1 The Licensee /Guest agrees to pay the Licensor the Licence Fee for the Term prior to occupying the Premises. Payment of the Licence Fee / Accommodation fee constitutes the client’s / Guest’s acceptance of the terms of this agreement.
- No Exclusive Possession
5.1 The Licensor retains at all times a right of entry to the Premises, including (without limitation) for:
(a) cleaning and servicing;
(b) inspections; and
(c) repairs or maintenance.
5.2 The Licensee / Guest acknowledges they have been granted only a personal right to occupy, not exclusive possession. - Use of Premises
6.1 The Premises may be used only for short-term residential/holiday accommodation.
6.2 The Licensee / Guest must not:
(a) assign, sub-licence or share occupation;
(b) use the Premises for unlawful purposes;
(c) cause nuisance or disturbance to neighbours. - Termination
7.1 The Licensor may terminate this Agreement immediately if the Licensee / Guest breaches any term.
7.2 On termination or expiry, the Licensee / Guest must vacate and return all keys/access devices. - No Proprietary Rights
8.1 The Licensee / Guest acknowledges and agrees:
(a) This Agreement confers no tenancy, leasehold, estate or interest in the Premises; and
(b) The arrangement is a personal contractual licence only. - The Licensor will make every effort to ensure the property is available as booked. However, the Licensor reserves the right to make alterations to bookings due to unforeseen circumstances.
- To secure your booking, a deposit of $300 or 25% (which ever greater) is required. Payment may be made by bank transfer, MasterCard or VISA (a 2% surcharge for credit cards). For Christmas a 50% deposit is required at time of booking. Final payment of balance is to be paid at least 2 weeks prior to arrival.
- Credit card details are required at time of final payment in lieu of a $300 security bond.
- Check-out time is 10am. Check-in time is 2pm. The Licensee / Guest must vacate the property by the check-out time unless agreed with the Licensor in advance that they may stay longer. Without prior agreement, additional late departure fees will apply at the nightly rate. No check in is allowed unless the agreed payment has been made in full. Bungunyah Apartments is a self-check in property. At time of final payment details of access code and arrival instructions will be given. If arriving late, please inform management so a welcoming light will be left on for you.
- All premises are to be left in a satisfactory clean and tidy state, including all garbage wrapped and emptied into outside garbage bin and washing and drying of dishes done. In the event of excessive cleaning requirements an extra cleaning fee, a minimum of $100.00 will be charged to the guest’s account.
- Pets are not allowed, and smoking is not permitted inside Bungunyah Apartment’s buildings.
- Parties and Functions are strictly prohibited. The price charged is for domestic use only and not commercial. Accordingly this rate does not allow for the extra wear associated with functions in terms of cleaning, garbage removal, wear and tear, repairs etc. Use contrary will result in additional payments.
- Any damage, breakage or loss of furniture, furnishings, equipment, locks or keys is to be reported immediately and paid for at cost, other than acceptable wear and tear. Please note, that our cleaners do a detailed inventory check both before and after your occupation. Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. The BBQ must remain on the outside patio and be cleaned after use. It is not to be moved from the position it is placed in.
- The number of guests should not exceed the number stated on the Confirmation Notice. Additional fees of $75.00 per person per night will apply for excess guests not notified to the Licensor in advance.
- The Licensor takes no responsibility whatsoever for the Licensee’s / Guest’s personal property left on the premises. Any property left on the premises after the Licensee / guest has checked out will be disposed of after 3 months.
- Wireless internet is provided free of charge.
- For stays of more than 8 nights, we provide a weekly servicing of your villa, which is compulsory to help us maintain our high standards of maintenance and cleanliness and ensure the property remains comfortable throughout your visit.
- The Licensee / Guest making the booking must be 18 years or over.
- For call outs outside of office hours, a $50.00 fee will be levied. e.g. if you lose your keys or lock yourselves out.
- In the event of cancellation by the Licensee / Guest more than 2 weeks before the arrival date, the deposit is refundable less a $50 administration fee plus associated credit card fees if applicable. In the event of cancellation of the booking or no show within 2 weeks prior to arrival then no monies will be refunded unless the property is re-let for the entire period of the cancellation. In this instance, a $100.00 administration fee will then apply.
If a booking is for more than 4 weeks, payment for the following month must be made 2 weeks prior to the next period otherwise the booking will lapse.

I had a wonderful stay here. The place was very clean with a cosy, peaceful atmosphere that made it easy to truly relax. The owners were friendly, and helpful which made the stay even better. It had everything I needed, including a full kitchen with a full‑size fridge and a washing machine. The surroundings were beautiful, with trees and well‑maintained gardens that added to the calm vibe. A great spot to unwind and settle in.

Rooms are very clean, the house is very cosy and welcoming. The location was very convenient for us. The services wasn't great for the value of money, you will pay the hotel price but only one towel for each person even we have booked it for 10 days for 4 adults and 2 paper towels and not even an iron. We went in summer and the rooms were so hot because the air-conditioning is just in the dining room and only one small fan for 2 rooms. when you pay hotel prices you would expect abit more

We can’t thank the team enough at Bungunyah apartments for all their help. We stayed here while our house was being fixed for four months and it was a fantastic experience. Henriette made the whole process so easy and the townhouse was lovely. The kids loved the towel animals each week. We Would highly recommend bungunyah appartments
